August Home Publishing Company Photograph and Image Agreement

* This Agreement is made by and between August Home Publishing Company, dba Garden Gate magazine ("August Home") and the owner of the submitted photographs or images ("Owner").

* Owner grants to August Home a perpetual, nonexclusive license to use, reproduce, prepare derivative works based upon, to distribute copies of, to display publicly and publish the submitted photograph or image in any and all forms of media including but not limited to publications, on the internet, and electronic formats. These rights apply to all forms of media in which August Home is involved, either alone or with a third party. Further, August Home shall have the right to alter or touch-up such photographs or images without approval or permission from the Owner.

* Owner represents and warrants that: (i) each image is original and does not infringe any existing work; (ii) Owner has the right to make this Agreement and to grant the rights herein granted; (iii) Owner is the photographer or has an agreement with the photographer to allow Owner to grant these rights to August Home; (iv) Owner has obtained all releases (property and model releases) necessary to grant the rights contained herein; (v) Owner shall indemnify and hold harmless August Home, its parents, subsidiaries, affiliates, sublicenses and permitted assigns, and their respective officers and employees from and against any and all claims, charges, costs, causes of action, judgements or liabilities (including, without limitation, attorney's fees) that may arise as a result of a breach by Owner of its representations, warranties, or obligations hereunder.

* There shall be no payment or consideration from August Home to use the submitted photographs or images in any and all forms.

* This Agreement shall be interpreted, construed, and governed by the laws of the State of Iowa.



Parents and Children

August Home's web sites are not directed toward children and August Home does not intend to collect personally identifiable information from children under the age of 13 without the permission of the child's parent or legal guardian. Children under the age of 13 should submit personally identifiable information to August Home only with the explicit permission of their parent or legal guardian.

To comply with the U.S. Federal Trade Commission's Children's Online Privacy Protection Act of 1998 (COPPA), when you check the "I Agree" box below you are telling us that you are 13 years of age or older.

NOTE: If your child has submitted personal information and you would like that information to be removed from our database, you may contact August Home and we will use reasonable efforts to comply with your request.

Follow these tips from the Garden Gate pros.

Take photographs in the soft light of early morning, evening or even cloudy days. Mid-day light is usually too bright.

Use a solid or plain background behind your container to make it easier to see the plants.

Take shots from more than one angle

Fill the frame with the container — too far away and it's hard to see what's there.

If you have a digital camera make sure the resolution is set high.
